Terms of Service

1. Acceptance of terms

By creating an account or using TherapAI ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use TherapAI. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these terms.

3. Not a medical or mental health service

TherapAI is an AI-powered emotional support tool. It is not a substitute for professional therapy, counseling, psychiatric care, or medical advice. The AI does not have clinical training, cannot diagnose conditions, and cannot provide treatment.

If you are experiencing a mental health crisis, thoughts of self-harm, or a medical emergency, please contact emergency services or a licensed professional immediately.

4. Subscription and billing

• Free trial: All plans include a 7-day free trial. You will not be charged until the trial ends.
• Solo Plan: $4.99/month, billed monthly
• Couple Plan: $9.99/month, billed monthly, covers both partners
• Auto-renewal: Subscriptions automatically renew unless cancelled before the renewal date
• Refunds: We offer a full refund within 7 days of your first charge if you are unsatisfied. Contact support@therapai.health.
• Payment processing: All payments are processed by Stripe. We do not store payment card data.

5. Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain full access until then. To cancel, email support@therapai.health with your account name and the subject line "Cancel Subscription."

6. Acceptable use

You agree not to use TherapAI to:

• Harass, abuse, or harm another person
• Generate illegal, harmful, or deceptive content
• Attempt to extract or reverse-engineer the underlying AI model
• Create fake accounts or misrepresent your identity
• Use the Service for any commercial purpose without written permission
• Violate any applicable law or regulation

7. Partner sharing consent

On the Couple Plan, both partners consent to the possibility of receiving shared summaries from the other. Shares are always initiated by the sender and are never automatic. By using the Couple Plan, you acknowledge that your partner may choose to share summaries of their sessions with you.

8. Intellectual property

TherapAI and its original content, features, and functionality are owned by TherapAI and protected by copyright laws. You retain ownership of the personal content you share in sessions. You grant us a limited license to process your content solely to provide the Service.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI responses will be accurate, complete, or suitable for any particular purpose.

10. Limitation of liability

To the maximum extent permitted by law, TherapAI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Changes to terms

We may update these Terms at any time. We will notify you via email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions.
